Guidelines for the Use of the Review System

  1. The User may not misuse the Review System, in particular not create the impression that the quality of his services is particularly good by means of positive reviews created by himself or on his behalf and also not use untruthful information to ensure that negative reviews from customers are not included in the Review System.
  2. The User is prohibited from using threats or aggressive behaviour to influence the customer or the Trusted Shops employees to change a review that has been submitted.
  3. When creating comments on reviews, sections B and D of the Terms and Conditions of Use for the Trusted Shops Feedback Platform apply accordingly.
  4. The User shall not offer its customers any benefits, special conditions, discounts or other incentives in order to induce the submission of a positive review or the withdrawal of a negative review.
  5. When sending review invitations by e-mail, the User must also comply with the applicable law (including all data protection and competition law regulations) and in particular refrain from including any criminal, offensive or technically harmful content.
  6. If a review is illegal from the User's point of view (insult, abusive criticism or untrue factual claim), Trusted Shops checks the respective review manually and deactivates objectively illegal reviews. If, in the opinion of the user, an image attached to the review violates legal regulations and/or the terms of use of the Review System, the image is checked accordingly by Trusted Shops. If Trusted Shops finds a violation, the image is removed. The rest of the review remains in place if it is not objectively illegal in itself.

Supplementary regulations for users of paid features:

  1. The User must ensure that only reviews based on a referenced experience of a customer, user or prospective customer can be transmitted to the Trusted Shops review system. However, the User must transmit these reviews in their entirety - not only selected positive ones, but all of them. Accordingly, all customers, users or prospective customers are to be asked equally for a review in a neutral manner, regardless of the expected feedback.
  2. The User will supply this review data exclusively to Trusted Shops and will not use the reviews elsewhere on the Internet for advertising purposes unless a separate agreement has been made for this purpose. In particular, Trusted Shops solely is entitled to transmit the reviews to Google as part of the Google Seller Rating Program.
  3. The User is obliged to support Trusted Shops upon request in verifying the authenticity of a review and, if necessary, to provide truthful information for this purpose without delay and to submit documents and evidence.
  4. Insofar as the User wishes to use the option of asking customers by e-mail for a review via the Review System, or uses the Online System for this purpose and dispatches review invites via Trusted Shops, it acts as the Data Controller and is thus responsible for the processing of customers’ personal data (e-mail address and, if applicable, other). As the Controller, the User must comply with all relevant data protection regulations. Particularly, it must, in a neutral manner and in accordance with legal requirements, inform its customers about the purpose of the processing and, before using the Review System, the express consent of each customer to use and, if necessary, transmit their email address as well as potentially other personal data further for this purpose.
